    Asylum Seekers Win Court Case

    Six asylum seekers have won a High Court challenge against tough new laws they claimed were unlawful and "inhumane". The judge said Government rules denying them benefits and shelter breached the European Convention on Human Rights.The 2002 Nationality, Immigration and Asylum Act came into force last month.

    It said an asylum seeker has to make a claim at port of entry or as soon as "reasonably practicable". In the past, asylum claimants were given months to make their claim.

    Government figures show approximately 60% of refugees do not make immediate applications upon arrival.

    The new law means they are not entitled to Government-funded living costs or housing benefits.

    Lawyers for the six asylum seekers said it forced many refugees to sleep rough.

    Mr Justice Collins ruled the initial decision making process which led to the six being refused assistance was "flawed".

    Another 200 asylum seekers are now expected to challenge decisions to refuse them help.

    David Blunkett said he was "deeply concerned" by the court ruling and the Home Office would appeal.

    He said: "This measure is an important part of our asylum reform programme which is dealing with widespread abuse of the system and reducing unfounded claims.

    "It is simple common sense that asylum seekers should lodge their claim as soon as they arrive if they expect support from the Government.

    "The law that people should claim asylum as soon as is reasonably practicable, and that we cannot provide support unless they do, still stands.

    "We must continue to be able to operate a robust policy and people who try to abuse our asylum system will not find us a soft touch."

    A record number of asylum seekers arrived in Britain last year, while in other European countries the figure fell.Almost 110,000 applicants and their dependants were recorded - up
    20% on the previous 12 months.

    The Home Office said that in comparison, figures across the EU - excluding Italy - fell by 1% during the year.

    During 2002 a total of 8,100 people were granted asylum, 19,965 were granted exceptional leave to remain and 54,650 were refused asylum.

    The Government deported a record number of failed asylum seekers in the last three months of 2002, just over 3,730.

    In all, 13,335 failed applicants and dependants were removed during the year - another record figure but less than half of the Home Office's original target of 30,000 a year.

    Home Secretary David Blunkett said: "The provisional figures for 2002 are deeply unsatisfactory but no surprise, with applications from Iraq and Zimbabwe accounting for
    nearly all the increase from 2002.

    "2002 was a difficult year with scores of illegal entrants breaching Channel Tunnel security.
    "We have tackled these problems and are beginning to see results."

    He announced that the category of exceptional leave to remain will be replaced by a narrower category of "humanitarian protection" from April 1, when the first enforced returns of failed asylum seekers to Afghanistan will also begin.

    Shadow Home Secretary Oliver Letwin said: "These are pretty dreadful figures to put it mildly.

    "This system is bankrupt, broken, it doesn't work. We've all lost patience with it and the only
    thing to is to scrap it and replace it."

    And how exactly will going to war with iraq half these figures... tony blair needs his head checked... he pledges to half asylum claims (which is inhumaine - he's sending people to their death for the sake of a ballet... Halfing bogus claims would be a far better sollution) then declares war on iraq - even though iraq have complied to all the US/UK/UN demands...

    Sheik Ali Hamsarni Muhahahahahahaha has decided to enter the race to be the first Islamic Prime Minister.
    He knows he will win, he says "because all of the indiginous population of the UK haven't been breeding for the last 30 years and all the asylum seekers have been doing nothing but immigrate & multiply all this time. Oh - and the 'original British nationals' can't be arsed to vote anyway so we'll get in without any trouble at all".

    And then what? You can keep your 'Crasher, your Promise - all of it - coz they'll outlaw music, dancing & having a good time. And sexy laydees in slinky clubgear....

    Why? Coz we've been asleep - we let them pass all these laws under our noses cos we can't be arsed to vote!!!!!! Too busy reading the Sun page 3 (phwoar! look at the veil on THAT!) and watching Big Brother/Pap Idol, that's what it is peeps.

    Okay - so all polititians are villains & idiots. So what's new? It never stopped our parents voting....

    Looks like my 'Original british nationals' phrase has been misinterpreted as a racist's rant.

    DOH!!!!

    Yeah we've always had immigration for all kinds of reasons & I'm ALL FOR IT but things have got out of hand. A lor of people are taking the mickey BIG TIME, and if things continue at the rate they're going, the scenario I imagine in my last post COULD happen one day.

    There's a good reason thousands of assylum seekers want to come to Britain - we're a soft touch on spongers.

    We can't be arsed to vote to change the things that affect our lives - not that most of the country even have a clue what's going on.

    We're all so wrapped up in 'our freedom' - but the very same freedom ideals are being used against us and MAY (some cynics say) be our undoing.

    Just my 2p worth.

    The Home Office will forcibly repatriate a number of Afghan asylum seekers after a voluntary scheme only attracted 39 applicants.

    A Home Office spokesman said "a small number" of Afghans who had been refused leave to stay in Britain would be on a non-stop chartered flight on Monday, the first of a number of planned removals.

    The more robust approach follows a six-month trial voluntary repatriation scheme which offered up to 600 pounds of support for individuals and 2,500 pounds for families willing to go back to Afghanistan.

    Home Office officials had hoped that around 1,000 Afghans would take up the offer.The 39 who did sign up for the scheme have already returned.

    Asylum has become a contentious political issue in Britain, which received over 110,000 applications last year, the most in the European Union.

    Government figures show that some 3,285 Afghans were refused asylum or exceptional leave to stay in Britain in 2002.

    However, in the first nine months of 2002 just 345 were removed from the country."We are beginning with a small number on this first flight," said the Home Office spokesman. "We need to ensure the process is sustainable, that there is adequate infrastructure,there is security on the ground to receive them. Once we can establish that, we can
    build on this," he added.

    Until last July, the vast majority of Afghans who were allowed to stay in Britain did so under so-called "exceptional leave to remain" status, as Afghanistan was not considered safe.

    Since the fall of the Taliban regime however, Britain has stopped granting this status to Afghans failing to qualify for asylum.
