tenancy agreement

    Read the tenancy agreement carefully and if you're still not sure get legal advice either from a solicitor or the CAB. Know your stuff before discussing it with the landlord as well, some will try and con you.

    A) Have you and each of your housemates mates got individual agreements?

    B) Or is there one single agreement over the whole house?


    If its A, then you wont be liable for the person leavings rent. However the landlord may put any old random in that spare room with yous.

    If its B, then you will be liable for the rent. Because basically the agreement will have stated in it, the whole monthly rental figure for the whole house.

    if you signed a joint tenency agreement and they don't pay, the landlord can try an make you pay for it/not give you your bond back etc...

    this year instead of getting my 200quid bond back they expect me to pay 80quid cos one of my housemates decided they didn't need to pay rent anymore.

    linzi if you need to me to read over the tenancy agreement without splashing out on a solicitor feel free to pm it to me. some letting companies / landlords have all sorts of ridiculous clauses in there standard terms and conditions, most totally unenforceable in a court of law though.

    yeah in ours it says we can't keep a boat in the house! :spangled:

    an the use of illegal drugs isn't allowed either... but i thought that was agiven seen as they're illegal anyways?? :confused:

    As far as I know, if you get done for drugs in your house, the landlord can get done too for allowing drugs to be used on his premises. That clause probably gets him out of it.

    :lol: yeah there are some strange ones out there. some of them like to put the illegal drugs clause in to student houses, basically the logic is if you are wild bunch of students and have alot of massive parties etc.. eventually the police will be called, find drugs, and in light of such event the landlord would try and evict you. 99 times out of a 100 they would still fail to get an eviction order for something like that.

    it would have to be proven he had knowledge of someone dealing and did nothing about it. a crime requires a minimum of negligent intent.

    Basically if you have one joint agreement, the point is that you have between you signed up to pay the Landlord say £600 per month. If someone leaves, that is still the case.

    More common in student lettings, the Landlord issues seperate agreements to each individual where they are only agreeing to pay for their room, (say £200 per month). So if someone disappears in this case, you are not responsible for their rent.

    Just example figures used really to illustrate.
