    Pubs do however have a responsibility to ensure that there are barriers of at least a reasonable height (I wouldn't like to be on a busy pub balcony which only had a barrier that was a foot high, for example). Pubs also have a duty to ensure that the floors aren't slippery etc (difficult with hard floors and clumsy people spilling pints).

    If the barrier is of a reasonable height, and the floor is dry, then yes, it is your own responsibility.

    The fact the guy was so drunk when he fell will at least help him, he would of been a bit more relaxed that a sober person taking a nose dive.

    complete bullshit. so if he had died, it would be tough, becuase he was drunk and was therefore clumsy? You talk such absolute wank like.

    I've thought for a long time that the bannister up there is far too low. You could be sober and trip backwards or something and go straight over the top.

    This is a case where a claim is by no means unjustified. That bannister should be a good 2 feet higher at least. I'd sue the arse off them like.

    they have to cut costs somewhere becasue of the cheap drinks, thankfully they did it somewhere where they can kill off a few scrubbers that drink in there, get a few of them off the streets:lol:

    years ago when i worked in a pub this woman tried to sue...she had recently had a hip replacement & was in the pub drinking...she spilt her own drink on the floor & then fell over...she tried to claim it was our fault for the floor being wet when she had spilt it shortly before falling over...it didn't work like...

    we argued she shouldn't ave been dancing so soon after a hip replacement :p

    If the banniser in wetherspoons was a few feet higher then the lad probably wouldn't have fallen, drunk or not...simple as that.

    a while back in blu bambu a lass i know (who was out sober) tripped on a step on the spiral staircase at the back and actually fell THROUGH the gap at the side of it and hit the floor, breaking her pelvis.

    They then put horizontal rails around that to stop it happening again. But I suppose the lass should take social responsibility for falling over in the first place eh?

    They have to take reasonable steps to make sure their place is safe and you have to be reasonably careful.

    What 'reasonable' is is another quetion entirely - when I was in Guatemala this summer, it was very refreshing to be able to climb up huge slippery ruins, knowing that if I fell (and people did) it was my fault and noone was going to help. In the UK, they would've been roped off and you wouldn't have got within 20 feet.
