that is my point, can't say i have either. so you are nearly always dealing with something that is inferred which makes the whole thing extremely subjective and difficult to create general rules for.

but how could they prove she wasnt concious?? she might of just had to much to drink and cant remember and is feeling really guilty for sleeping with someone. The same can go for a man.

in those cases if it was taken all the way to court, although you would hope the CPS would have the sense not to on something as circumstantial as that, it unfortunately would come down to who a jury believed most.

All these rape claims on the professional footballers and now this ludicrous idea are only making it harder for the genuine victims of rape to have the courage to come forward.

If this is passed blokes could then claim rape when waking up with a 15 pinter like snugglybum.

I agree in principle with the people behind this that it would certainy be good if fewer women (and men) got raped/sexually assaulted.

What I don't agree with is the £250,000 spent on it, when cancer patients are doing without decent scans because there's no money to fund it.

The issue of sex consent like this doesn't lend itself well to the legal system, as a spontaneous decision is hardly likely to be documented or considered.

I think this is likely to draw attention to this issue, which isn't bad in itself, but I could see a few women interpreting this to mean 'If I didn't say yes explicitly then I was raped', which is clearly wrong, and may lead to a rise in false accusations.

We shouldn't underestimate the effect of a young man being labelled a rapist falsely either - I read an account of this once in the Times and it sounded terrible for this 14 year old guy. He had no support from the legal system, and it was later found that the girl (who had given him a blowjob in a park) was worried that if it came out that she had done it, it might lessen her chances with some other guy.

In summary - this is a grey grey area, and not one the conventional legal system is well equipped to handle, and I think the money could have been used to achieve more beneift elsewhere.
