I think it's totally shit they're doing this. There'll still be loads of free "illegal" parties taking place on private and waste land, but clubs like Space and DC10 are so good because of their morning parties.

However, I'm sure if a club has not been open the night before they can open at 12pm. If they have been open the night before, then it's 4:30pm at the earliest.... I think.
