    It applies to both as far as I'm aware, all the websites I've read say both types of penalty charge are unlawful and can be reclaimed.

    I'm giving it serious consideration now...

    :eek: Can you not access them through online banking mate?

    As an aside, a mate was trying to get charges back from the halifax - they offered him £500 but he turned them down and is trying to get a grand back. Given he's in about 6 grand of debt across several student accounts i'd have taken the £500!!

    I'd strongly recommend signing up on www.consumeractiongroup.co.uk. I've followed the process using the guidance on that site, and I just received a letter from Lloyds' solicitors last week offering me a full settlement of my claim (about 700quid) :D

    out of all the banks, Barclays are the one of the few banks that try to make it as hard as they can. They tried to offer us £45 for the £120 worth of charges we are claiming for. Barclays refused to accept or claim for the full amount so we have on started the small claims procedure agianst them.

    If you look on www.consumeractiongroup.co.uk like
    French William says, Barclay tend to refuse to pay the full amount unitl you take legal action, then they pay at the last mintue so they dont have to go to court.

    Think I'm gonna look into this..
    I've been a right muppet with finances in the past and now I'm gettin myself in order a little more cash to steady the situation would be helpful..

    Its not like they're gonna miss a few hundred quid is it..

    FFS. Live within your means. When you know the banks will charge for for spending money that's thers's and you still do it why should they give it back to you

    The charges contravene english contract law and common law. The bank is effectively stealing. Whether I manage my finances efficiently or not is irrelevant, it's my money that they've unlawfully taken, and I now have it back.

    people are not just claiming for overdraft charges, they are also claiming money back for when bank stops direct debit from being pay due to lack of funds, then write you a letter and charge you £30 + for the privilege, there for your not spending the banks money, but they have illegally taken money from your account.

    But you think the banks should be able to get way with breaking the law?

    I' not talking about whether banks are breaking the law.

    I get customers on all the time that get charges my our direct debit company for not having enough money in their account when they know fine well how much the payments are and when they're due to be taken. They come on the phone shouting at me when it's their own fault for not managing their finances properly.

    I don't spend money I haven't got and pay my bills on time, therefore don't have any charges to pay, don't complain about being charged, and don't have to try and get money back.

    I ran two overdrafts and two credit cards as a student, and got charged to fuck left, right and centre.

    It takes some reading to get through it all, but it covers absolutely everything you're gonna need to do/know. Glad you found it useful.

    a few months over the years i have been charges 38 quid for being 3 or 4 quid short of my council tax money..cunts

    exactly!

    We had npower take double payments out by mistake once the same day as 3 other direct debits were due. 3 x £30 charges. Even thought we'd made sure we had the money in to pay all the bills.
