Downloading music and getting caught

    Downloading music and getting caught

    I was just wondering, since it seems like the amount of people getting caught downloading music illegally is on the increase (or at least being made to seem that way?) these days, what are the do's and dont's?

    Are sets from p2p programs such as tiesto of pvd free or are you supposed to buy them too? Maybe a silly question but i've heard that sometimes ur not meant to be able to get certain sets from certain places.

    Secondly, are there certain methods of tracking people being used? Like is it just p2p users who are being caught? I've used XDCC a lot and from what I can see it's a fairly private method of downloading in the sense that you enter a chatroom and a 'bot' sends you something. Essentially its one guys computer that is transfering the file(s) to you. Maybe i'm just being blinded by the 'you to me' system used and if there are more complexeties going on such as IP's being sent somewhere then I'd love to know.

    From what I hear here and there it seems like the majority of people are being caught on p2p networks. And maybe bit torrent?

    Cheers. Maybe this should be in the techy geeks corner but I think everyone has heard of people being fined thousands for something we all do everyday so i'm sure it'll be of interest to people here too :)

    I was wondering too this cos it was on Radio yesterday.

    I don't download many albums and that but I do have a hell of a lot of tunes and sets.

    But guess there hasn't been many people caught compared to the amount of millions that actually download.

    Plus the majority have been kids downloading all the cheesy chart stuff-bless them:p

    I know they're cracking down in the USA but not heard much over here.

    Bit Torrent - u can't be done for - it's the hosts of the servers that seem to get hit.

    P2P - Some software now has 'built in' elements that keeps your details secret - but eventually they could trace you - if they could be arsed - but it's not simple/cheap... only worth doing the BIG sharers of new music.

    Mixes - i'm not sure - they contain copyrighted material - so unless they've received express permission from the DJ and or CLUB and or the individual owners of the the tracks - they SHOULD be also classed as normal MP3s. i dunno what the legal stance is... as DJs/people seem to put them up for download across the world...

    No network or system is 100% safe, that goes for IRC channels too (about 3 months ago a huge group of movie sharers were all prosecuted on galaxynet and the channel closed down).

    As for the legitimacy of content, certain stuff on p2p is free and available for all (linux being the prime example for torrents), but most of it ain't.

    As for artists sets being available, it only tends to be legit if:

    a) It's hosted on their site

    b) It features musical works that are either their own or that they have paid the appropriate PRS/MCPS licence fees.

    As for cracking down, I'd imagine that the BPI will take a similar stance to the RIAA and target large sharers in an attempt to scare people, stories of 12 year olds being prosecuted for sharing music will scare the average daily mail reader into not downloading.

    It's dead easy to trace people who you're downloading from/uploading to, just bring up a command prompt and type netstat, then it's a visit to www.ripe.net/perl/whois to see who owns the IP address...

    It's more a case of 'setting an example' to people at the moment. Weather or not this will change into a mainstream attack at everyone is beyond me. it would take some time and money but you never know.

    I got told off my dad yesterday about a 14 year old girl that got done for downloading 1500 mp3's or something and fined £4000 (I think). Apparently (once again, I 'think' - this maybe part of another similar story) the girl and her mum couldnt afford to pay the fine within the given time and the mother might goto prison now since the little lassy is too young to go herself.

    So this leads me to think it's not just the people responsible for sharing huge amounts of music who are getting done as there needs to be scare-tactics used to stop people downloading small amounts too.

    I know the chances are slim but it still gets a bit worrying thinking about how much you actually owe if someone does decide its your turn to take it up the arse :lol: :oops: :(

    To be honest, People who downlaod illegally fall into two catergories

    1) Clueless, fuckwits with no talent, so they use illegal sites to get tracks people have never heard in the hope it'll make them look better when they play out.

    2) People who pretend to like music, but don't actually like it or respect the artists enough to give them their fair dues.

    And, if they don't understand what they're doing to the industry then they deserve to be caught and convicted of copyright infringement - at the end of the day - they are just common thiefs - so should be treat as such :D

    hairy - i disagree, how can trying to keep on top of things musically be wrong? maybe in some cases your right but not everyone has decks so can't buy records to start with, and not all tracks can be got by digital download, so people have no choice if they want to hear the music they love.

    on a seperate note - my 2p - i'll buy anything i like, if i dont like something i dont buy it, and generally speaking i only download livesets really. but it's still a very touchy legal area, so where does this classify me? am i 'killing the industry' with my livesets?

    To be honest I'm not going to pretend I don't download music illegally when I do! Sorry but I'm not going to pay to download stuff when it is so easy to download odd songs which there is no way possible of me getting on cd etc! I buy albums etc but thats it :confused:

    you should be mates with cocktrickle

    1) i couldnt give two shits about the artist or record company loosing money(they shouldnt charge ridiculous amounts of money for it in the first place). its music not gold FFS

    2) i dont see the difference between someone buying an album and letting your mate borrow it (ie p2p file sharing)

    3) i dont d/l alot of stuff but i'll be damned if im going to pay.....

    £7 to see a film i might not like

    £15 for an album i only like one song on so far

    £45 for a game that might be put to side after a few days of playing

    what are you on about stop trying to twist my words around, i gave a valid reason why some people go ahead and download music, i dont think its right but some people dont have the money to fork out loads on vinyl etc

    I dont play out or use my decks but i still download stuff to listen too.

    Yes its illegal but its not like im using them to my advantage to play in sets as i dont use them or own a cdj.

    So am i clueless fuckwit with no talent (No wise cracks) or am i someone who pretends to like music but i dont actually like it or respect it?

    for the record i pay for my downloads aswell seeing as i have a cd deck and think its only right, but i still see where other people are coming from who just like listening to music on their computers :)
