Cheque fraud (kind of)

    I didn't really think about it at the time. As it was payday i presumed the funds would be in my account, so never anticipated a problem.

    Think I'll take the teknofinancialadvisor route, and ignore them for a while. See what comes of it.

    But by doing that you have had to write even more to try and show that you aren't actually as stupid as you first came across talking about things that don't exist :p

    Never take notice of any letter requesting payment unless its a court summons.

    Aye thats what i wud do...if they do have a probelemo with it, just send them another dateposted cheque so they can take the money out in jan, or whenever u have the money :)

    their only possible route is the phone company and bank both of which are not allowed by law to pass on any personal details

    id guess "the embarresed Frenchman" who just been given a offical warning for not doing his job properly and had been told to call you himself and try and get the payment. Maybe you wont hear from them again.

    Wouldn't be too surprised if that's right. I told him my wallet's at home, so call me again after 6, and he said his shift finishes at 6. If he was some finance/accounts guy he wouldn;t have said shift. And who would really employ a frenchie in position above waiter?

    Just have to ignore 'anonymous' calls now, which isn't a problem as a withheld number normally means work are ringing, and so generally gets ignored anyway.

    you actually have to pay. as they have the cheque and your account number they will be able to have a word with your bank easy enough. if they do chase it up, for the sake of 150 quid just pay it, certainly would prefer that to court

    you know and your bank can prove to them that your cheque limit is 100 quid and you know it won't clear and will more than likely get done for fraud.

    if the restaurant is prestigious enough to do it to make an example out of non paying party. wouldn't fancy a solicitors letter demanding 500 quid for lack of payment or a day in court. if they have 150 quid to chuck away, they have equally as much to spend in getting it back and more!

    There is nothing wrong with the fact i used a cheque to pay for something over my guarantee limit. This isn't illegal or wrong in anyway, it's just most companies/businesses won't let you do it as they have no safety net. If you are spending more than your guarantee limit most shops will ring a clearing service and authorise the cheque that way.
