Re: Worst night of my life.

You deserve a Criminal Record for stupidity alone.

There where no witness's and just his word against yours.

The simple words "Oh no I didn't" would have got you off.

LESSON FOR THE DAY: HONESTY GETS YOU NOWHERE

Very true (when it comes to legal matters).

You cant get a criminal record without going to court and being given one.

You must be pretty scared right now and your probably not thinking totally straight but in all fairness you havent got anything to worry about.

If there are cameras in destination you'll get off
If there arent, you just retract what you said to the bouncer if thats been put on record on the grounds you were pissed/confused
Either way, even if it went to court - its the word of someone with a job versus that of some slime, a decent judge would see that.

Dont sweat it - you'll be safe as houses.

    :O

what the fuck, possibly the harshest thing I have heard all week

so, the bizzies arrested you, charged you with assault - surely you have to go to court and be tried before you get a criminal record.

    Alternatively, did they caution you?

Lame as fuck, i hope the charver sustained some terrible head injury from his fall.

I don't know shit about the british legal system tbh, but can tey really just arrest you charge you and find you guilty instantly, leaving a criminal record? I thought you had a right to a trial.

    Harry

Edit - I will read the thread next time . /fwap

if a caution was accepted - thats the end of it really... it probably won't go to court unless charges are pressed i think... in which case u can do as brid said, retract your story, say u were pissed/scared/didn't know what was going on - then it's your word against his.

Judges know the score - scumbag charver probably been in so much trouble against a first offence minor incident. Also the bouncer was probably playing everything by the books...

Looks what charv/burgulars/car thieves get away with nowadays - you've got nowt to worry about

I dont think saying u were pissed is a great idea.

    They would probs
    a) use it against you, as in "well if u were pissed, we cant really rely on your story"
    b) try and give you a d&d charge instead, if they cant make the assault stick

If you just got a caution then it wont be a criminal record.

Fucking hell, charvers need to be burned alive - all of them.

Chris - appeal against your caution - tell them to check the cameras in destination. That's really important.

I have had a fair few run ins with the police and its safe to say when it comes down to checking CCTV Camera's then 8/10 times they werent turned on or are broken !

I once got kicked to fuck at the Monument off 7 kids after last orders and it just so happened the cameras werent on nor was there for the first time ever no ticket inspectors/police at the top of the station

much of what has already been stated is right. i wouldn't stress about having a caution on your record though, unless you are going to be applying for jobs that actually do full police checks i.e. teachers, or anything really involving kids.

you don't have a criminal record hence a caution does not have to be declared to an employer. so my advice would be don't even mention it.

just pulled that off the home office website to reassure you.

sounds well harsh what happened to you, i would just draw a line under it you could make matters worse by contesting it and dragging it out. the fact is you have your caution and you won't have to spend any more time in the criminal justice system, unless you were to contest it, which could then potentially jepoardise your job.

Course you can, worst thing you can do is not turn up! Will be decided in your absence & non attendance is viewed in a very dim light...

TBH, I'd not worry too much about this case, self defence/provocation. :)

Really harsh what's happened though, the board's behind you anyway. :king:

I think this story is part of one of two reasons britain is in the state it is these days..

Not only is it a case of the more honest you are the more trouble u could end up in but also what happend to innocent till proven guilty..

This country is a fuckin joke!

Sorry to hear what happened, mate.

I came close to being knifed by a charva in Majestyks, Leeds. I somehow ended up in a conversation with him and he was saying he was upset about one of his family members dying. Everytime I walked away he followed. Eventually I went to the 'food counter' - get into a well lit area and all that - when he pulled a knife on me. Luckily by this time my mate realised what was going on and bouncers appeared from everywhere to kick him out. Except they said there was no knife on him:confused: :( If I was hammered and acting like a prick I would've deserved it, but I wasn't - I'd been to Goodgreef the night before and was too hungover to get pissed.

Morale of the story - stay away from commercial nights.

if there are no witnesses make a counter claim against him for assault
say he went to hit you first and it was self defence
say you have hurt your back or something
the injury doesnt have to be seen
then its your word against his
the cps will take no action under these circumstances
problem solved and no criminal record
trust me i know what im talking about
