the CPS should have taken the view that is was a waste of finance and not worth prosecuting.

admittedly - we don't know all the facts.

boiled my blood when i heard this on the radio this morning. what an absolute joke. i love the way the police say they were obliged to collect evidence. common sense needs to be applied in these situations, unfortunately in the police and the cps we have two public authorities who quite frequently show themselves to be completely inept when discretion is required. the cps also should shoulder just as much of the blame for allowing it to goto court as the officer in charge of sanctioning this ridiculous waste of public money.

end of the day the policeman who stopped her thought she was talking on a mobile and didn't want to look stupid so tried to get her done for eating an apple... 10 grand to save his face. bargain.

In this case changing gears, witching on/off air vents/conditioning (especially the one furthest from the drivers seat) and biting your nails at the wheel should all be illegal.

not to mention flicking radio stations or changing a CD..
